Environmental Services Regulator’s Code and Enforcement Policy

Purpose

In Environmental Services, our Regulatory Service's Regulator's Code forms part of the overall strategy for achieving compliance by businesses and the public with the legislation we enforce.

Our Enforcement Policy sets out the decision making process we take when deciding whether to prosecute or take other enforcement action. 

The Fixed Penalty Notice list states those offences for which we can choose to issue a fixed penalty notice (FPN). 

Our officers use powers delegated by the Borough of Poole to promote the image of Poole as a safe, healthy and welcoming place for all. We do this by taking appropriate action to protect the economic interests, health and safety of the public and the environment.

Environmental Services Regulatory Services of Environmental Health, Trading Standards and Licensing include:

  • noise control

  • environmental protection

  • air quality

  • contaminated land

  • nuisance investigation

  • pest control

  • food safety

  • product safety

  • health and safety at work

  • fair trading - focusing on the prevention and detection of rogue traders,

  • dog control

  • weights and measures and sales of age restricted products

Animal health includes

  • the welfare of farmed animals

  • illegal landing of animals

  • rabies outbreaks

  • port health

  • shell fish classification functions

The unit provides the corporate lead on envirocrime i.e.

  • littering

  • fly-tipping

  • dog fouling

  • graffiti

  • fly-posting

  • the administration of fixed penalty notices

Licensing services include:

  • licensing of alcohol and regulated entertainment

  • charity collections and a range of 20 miscellaneous licences, and

  • the administration of the Gambling Act

The purpose of regulatory action is to achieve compliance with legislation enforced by Environmental Services.

Compliance will be achieved by using the relevant statutory provisions and persuasive and educational techniques. This includes advice and support to traders through trade seminars, information leaflets, inspections, responses to complaints, enquiries and requests for assistance.

The effectiveness of legislation in protecting consumers and businesses depends on the compliance of those regulated. We recognise that most businesses want to comply with the law - we will endeavour to help these businesses and others to meet their legal obligations without unnecessary expense. When a business does break the law, we will consider all the surrounding circumstances before deciding whether formal action is appropriate. A prosecution will only be brought if it is in the public interest to do so.
