Community Infrastructure Levy

Borough of Poole gives notice under Section 212 of the Planning Act 2008 and Regulation 19 of the Community Infrastructure Levy Regulations 2010 that the Draft Charging Schedule was submitted to the Planning Inspectorate for Examination on 1st March 2012.    

The details of the Draft Charging Schedule Examination will be published on the Borough of Poole website when confirmed by the Planning Inspectorate.

Consultation on Statement of Modifications

Please note that the Borough of Poole has modified the Draft Charging Schedule that was published in accordance with Regulation 16 of the Community Infrastructure Levy Regulations 2010. The proposed modifications set out in this Statement of Modifications are as follows: MOD1 - Replace ‘Retail > 2,500 sq.m’ with ‘Superstores (as defined in PPS4) > 3,000 square metres’; MOD2 - Simplify the layout of the Draft Charging Schedule by specifying only those types of development and zones where a CIL rate is proposed; MOD3 – Simplify the layout of the Draft Charging Schedule by removing specific reference to those types of development proposed to be set a £0 CIL rate as these can be adequately covered within the ‘all other development’ category; MOD4 – Simplify the layout of the Draft Charging Schedule by removing all references to use classes; MOD5 – Delete the calculation of the CIL rate formulas re-produced from Regulation 40 of the CIL Regulations 2010 and replace with “ The council will calculate the amount of CIL payable (the 'chargeable amount') in respect of a chargeable development in accordance with the relevant formulae in the Community Infrastructure Levy Regulations (as amended).

Under CIL Regulation 21 (3) any person may request to be heard by the examiner in relation to the modifications set out in the above statement of modifications. A request to be heard by the examiner in relation to the statement of modifications must be submitted to Borough of Poole before the end of Thursday 29th March 2012 and include details of the modifications (by reference to the statement of modifications) on which the person wishes to be heard. All requests to be heard on the details set out in the statement of modifications received before the end of Thursday 29th March 2012 will be forwarded by Borough of Poole to the Examiner. Requests for the right to be heard on the matters set out in the statement of modifications were submitted to Borough of Poole by email and post.
