Garden Buildings

 

Small detached buildings

Small detached buildings may include; garden sheds, stores, workshops and other similar buildings.

A detached building, having a floor area which does not exceed 15m², and which contains no sleeping accommodation, will be exempt from the regulations.

A detached single storey building, having a floor area which does not exceed 30m², and which contains no sleeping accommodation, will be exempt from the regulations, provided that:

  • no point of the building is less than one metre from the boundary or its curtilage, or,
  • the building is constructed substantially of non combustible material

The definition of "constructed substantially of non combustible material" for roofs is: "Pitched roofs with timber rafters and a roof covering of slates, clay or concrete tiles."

NB: Flat roofs constructed of timber and combustible decking with felt coverings are not considered to fall within this definition and are therefore not exempt.

Health and Safety

The building owner and the builder must ensure that the erection of any exempt building will not cause danger to health and safety. You should ensure that your proposal will not affect:

  • flues from appliances,
  • any ventilation openings which serve any appliance,
  • ventilation openings to rooms, or 
  • any existing means of escape in case of fire routes.

 

 

Greenhouses

Greenhouses built for domestic use are, irrespective of the size, exempt from the Building Regulations. However, this exemption does not apply to greenhouses used for retailing, packing or exhibiting.

The definition of a "greenhouse" is:

"A single storey detached building with glass walls and roof, in which tender plants are cultivated."

Health and Safety

You must ensure that the erection of any exempt building will not cause danger to health and safety. You should ensure that your proposal will not affect:

  • flues from appliances,
  • any ventilation openings which serve any appliance,
  • ventilation openings to rooms, or 
  • any existing means of escape in case of fire routes.


Garages

Detached Garages

Attached and Integral Garages

Any garage which is to be erected as an extension of or integral to an existing building will require an application to be made.

Sanitary Fittings

If any sanitary fittings, WC's wash hand basins, or showers, are to be fitted in any exempt building, the fittings and their drainage will require an application to be made.

  • any ventilation openings which serve any appliance,
  • ventilation openings to rooms, or 
  • any existing means of escape in case of fire routes.

You may also require information on garage conversions.


 

Carports

An extension of a building at ground level by an attached car port, open on at least two sides, with a floor area not exceeding 30m², is exempt Building Regulations.

Sanitary Fittings

NB: If any sanitary fittings, WC's wash hand basins, or showers, are to be fitted in any exempt building, the fittings and their drainage will require an application to be made.
