The Scrap Metal Dealers Act 2013 (the Act) comes into force on 1 October 2013.
The Act repeals the Scrap Metal Dealers Act 1964 and consolidates scrap metal dealers and motor salvage operators under one licensing regime. Local Authorities will continue to act as the main regulator but the new Act gives Licensing Authorities more powers, including the power to refuse a licence or to revoke a licence if a dealer is considered unsuitable. Both the Local Authority and the Police have been given powers to enter and inspect premises.
Important Notice - Transition Process
To continue to trade after 15 October 2013 all existing registered Scrap Metal Dealers and Motor Salvage Operators must apply for a licence to the Council (Licensing) between 1 October and 15 October 2013
Any dealer currently registered under the Scrap Metal Dealers Act 1964 or a motor salvage operator already registered under the Vehicles (Crime) Act 2001 will be considered to have a licence under the 2013 Act until the council grants a licence or sends the dealer notice of its decision to refuse the licence provided an application has been submitted by 15 October. If an application has not been submitted the 'temporary' licence will end on 16 October. A new application can be submitted after 15 October but a dealer will not be able to legally trade until a licence has been granted.
If you have not been registered under the Scrap Metal Dealers Act 1964 or the Vehicles (Crime) Act 2001 before 1 October then you will not be able to trade legally after 1 October until a licence has been issued. Full enforcement of the provisions in the 2013 Act will commence from 1 December 2013.
To carry on business as a scrap metal dealer you must have a licence. Trading without a licence is a criminal offence. A licence will expire after 3 years.
There are two types of licence
Site Licence - All sites where a licensee carries on business as a scrap metal dealer must be identified and a site manager must be named for each site. This licence allows the licensee to transport scrap metal to and from those sites from any local authority area.
Collector’s Licence – this authorises the licensee to operate as a mobile collector in the area of the issuing local authority permitting them to collect scrap metal as appropriate. This includes commercial as well as domestic scrap metal. If a mobile collector operates within more than one local authority’s district, a licence will be required for each authority that (s)he operates in.

You and every person listed on the application form needs to submit a Basic Disclosure Certificate from Disclosure Scotland. You can apply online for a "Basic Disclosure" with Disclosure Scotland and there is a fee payable to them. The basic disclosure shall be issued no earlier than three calendar months before the giving of the application to the relevant licensing authority for it to be considered as valid.
